CBSE to challenge High Court Order; all set to approach Supreme Court

The Central Board of Secondary Education (CBSE) has  decided to approach the Supreme Court challenging the Delhi High Court order on Marks moderation policy, with a special leave petition. Since the Delhi High Court ordered the board to continue with its marks moderation policy for year the board officials have met Union Human Resource Development minister to consult the ministry to work out a way for the future.

The country’s biggest school board decided on Wednesday to file a “special leave petition” in the Supreme Court against the high court verdict.

According to sources, the board may file the petition within two days after studying the HC order. . The board’s appeal in the top court is unlikely to be filed before Saturday, sources said.

On May 22, the Delhi High Court had termed the CBSE Board as “Unfair and Irresponsible” as per the board’s decision to scrap the Moderation Policy under which grace marks are given to students in exams for difficult questions.

The CBSE along with 32 other boards had decided to do away with the marks moderation policy last month. The CBSE’s decision to go to the top court could affect students of eight state boards, including Haryana, Gujarat, Madhya Pradesh and Himachal Pradesh, which have declared their results.

Some of the boards who did not follow the moderation system might lose out to their peers from the Central Board of Secondary Education on grades or pass percentage should the Supreme Court decide to go with the high court’s verdict.

The fate of at least 1.5 crore school-leaving students hangs in balance as chaos over moderation of marks grows. Among the signs that CBSE approach the Supreme Court this year Delhi HC s order asking CBSE not to do away with moderation policy this year, several other school boards are likely to delay announcing Class XII results  as they wait and watch the developments.
